Seychelles: Judges to attend pirates’ trial today

Judges from the region who are attending a workshop on how to try pirates will today attend a court session in which 10 suspects will appear before Duncan Gaswaga.

Mr Gaswaga said this on Tuesday when Court of Appeal president Francis MacGregor opened the workshop at the Hilton Northolme Hotel, where they are looking for ways by which the judiciary can help to reduce piracy.

He said prosecuting pirates here has become easier after the National Assembly amended relevant laws so they apply more to Seychelles, and the courts rely less on British law.

The other judges come from Tanzania, Mauritius, Kenya and Maldives.

The workshop has been organised by the United Nations Office on Drugs and Crime (UNODC) to allow the judges to share ideas and hear how Kenya and Seychelles have been trying pirates, as the only two countries in the region that have done so recently.

Others taking part in the workshop include the UK Royal Navy’s senior legal adviser Neil Brown, who talked about the international response to piracy and its wider significance for security and conflict prevention.

Other speakers were prosecution adviser Shamus Mangan of the UNODC’s counter-piracy programme; Karen Clay, who is the European Union’s Naval Force liaison officer to Seychelles; and law reform specialist Alain Martinet.

Mr MacGregor said efforts to curb piracy are moving in the right direction, but listed hurdles that still have to be overcome.

He said though governance remains weak in Somalia, the Transitional Federal Government has a new prime minister who has produced a road map focusing on the critical priorities – reconciliation, good governance, security, institutional capacity and the constitution-making process.

“In this respect a high-level delegation from Somalia is here to discuss piracy and related matters,” he said.

“Success in these initiatives can give the necessary stability from which all the country’s problems – including piracy – can be addressed.

“The Security Council has agreed to increase the size of the African Union peacekeeping mission from 8,000 to 12,000 personnel.”

Mr MacGregor said Jack Lang, the UN’s special adviser on the legal aspects of piracy off the coast of Somalia, has briefed the Security Council, giving recommendations that stress the need for urgent action.

“The UN has stressed the importance of the trust funds that have been established to finance anti-piracy measures, and I take this opportunity to call for more contributions, including from the shipping community,” he added.

Mr MacGregor said until recently there have been no trials of pirates “since the famous ones of the 1700s and 1800s”.

“The first to be held in the US for nearly 200 years ended last year, while another started in Germany last year,” he said.

The difficulties in such trials include the fact that piracy is often not committed on land but on the high seas, where policing is almost non-existent, he added.

“The people on trial are often not nationals of the country where the trials are held, which brings in other aspects like language, customs and international repercussions,” he said.

“The ship’s flag, owner’s nationality and port of registration are often different, and so are the passengers and cargo owners.”

The seven week expedition was led by Cornell University's Erik Patel, who heads SIMPONA, a non-profit organization that aims to protect the silky sifaka and its habitat. Patel's team has found 31 silky sifaka groups consisting of 131 total individuals in Marojejy National Park in the past few years. SIMPONA was joined in the most recent survey by Madagascar National Parks, Madagascar's protected areas authority.

"I am encouraged by our latest survey results," Patel told mongabay.com. "Our latest survey region had been heavily impacted by illegal rosewood extraction in 2004/5 and 2009/2010. The groups found evidence suggesting that Rajoelina was involved in rosewood trafficking. The evidence included video footage of Chinese rosewood traders claiming to deal directly with Rajoelina.

In the Revue de l’océan Indien interview Rajoelina said the accusations are "all part of a strategy to destroy my image." He claimed that during his time as mayor of Antananarivo he made only a single visit to Guangzhou to buy materials for the city, including plastic garbage bins. He added that at no time was he involved in the rosewood trade.

"The rosewood industry is one that I do not know, I do not control, and which does not interest me at all," he said. "I reiterate that this report was written to discredit me."

But when asked about Rajoelina's remarks, Global Witness and the Environmental Investigation Agency (EIA) denied any sort of political motivation in their investigation.

"EIA and Global Witness are non-profit organizations dedicated to investigating and exposing environmental crime and corruption in natural resource trade," the groups told wildmadagascar.org in an emailed statement. "Each organization has worked for over a decade on illegal logging and associated trade around the world, exposing problems in both forest producer countries and consumer nations including the US, Europe and China."

The groups said their investigation emerged out of a request by the Madagascar government, in what they called “a commendable effort by the Malagasy agencies involved to understand and address this serious problem."

"Global Witness and EIA were contracted by Madagascar National Parks on behalf of the Malagasy Ministry of the Environment and Forest to investigate the illegal trade in rosewood, palissander and ebony, and identify those responsible on a national and international level. As part of this project we undertook research in China, Europe and US, which are the main consumer destinations for rosewood and ebony."

"The statements appearing to implicate the Head of the Transitional Government of Madagascar, Andry Rajoelina, were made by Chinese traders in illegal Malagasy rosewood trade during this investigation. If he wishes to demonstrate his commitment to tackling the urgent problems facing Madagascar's forests, President Rajoelina would do better to properly investigate these allegations and ensure that those suspected of illegal activities are brought to justice, rather than blaming the messenger."

Global Witness and EIA also released a transcript of the video segment when on of the rosewood traders refers to Rajoelina's visit to Guangzhou as mayor of Antananarivo.
[trader] When he was the mayor he came to Guangzhou with [redacted; Chinese name]. 01:03:24
[EIA] Oh so you knew him then? 01:03:27
[trader] Yeah, yeah when he was still the mayor. He and my partner came to Guangzhou. 01:03:31
[trader] The banners and caps for his campaign in running for the presidency were made in Guangzhou. 01:03:32
[EIA] Oh, you knew him then, of course! 01:03:37
"In our investigation transcripts, the same Chinese traders whose mentioned Rajoelina’s visit to China while he was mayor also commented that he had been in Guangzhou shopping for campaign items at the time," Andrea Johnson, Director of Forest Campaigns for EIA, told wildmadagascar.org. "So the President's comments arguably corroborate our first-hand evidence all the more."

WildMadagascar.org was unsuccessful in attempts to reach Rajoelina's office for response to the statement from EIA and Global Witness.

Rosewoodgate

The rosewood accusations have erupted into a political scandal in Madagascar. Supporters of Rajoelina blame the disposed president Marc Ravalomanana, while Ravalomanana advocates finger Rajoelina's administration for trafficking of the valuable timber. Both sides say that a "Chinese mafia" is involved in the trade.

Regardless of who ultimately bears responsibility, there has been a sharp increase in rosewood harvesting since the events that transpired in March 2009. A survey last October found extensive logging camps within the boundary of Masoala National Park, a UNESCO World Heritage Site renowned for its biodiversity. Other surveys have turned up evidence of traps used for catching lemurs, which are increasingly sold into commercial bushmeat markets, according to Conservation International, an NGO that works in the region.

Environmental groups say the government has been slow to crack down on loggers operating within parks, but international rosewood shipments have been greatly reduced due to international pressure and better policing of ports.

Madagascar is one of the world's top conservation priorities due to ongoing habitat destruction and its high levels of biodiversity. More than 70 percent of Madagascar's species are found no where else on Earth.

President Rajoelina has implied that WildMadagascar.org and Mongabay.com (wildmadagascar.org's parent) are part of an effort to undermine his rule. For the record, neither WildMadagascar.org nor Mongabay.com have any political agenda in Madagascar. Neither WildMadagascar.org nor Mongabay.com have any relationship with Marc Ravalomanana or his agents.

The primary interest of WildMadagascar.org and Mongabay.com is environmental issues. WildMadagascar.org and Mongabay.com have no interest in Malagasy politics.

- Rhett Butler, founder and editor of WildMadagascar.org and Mongabay.com

Antigua and Barbuda: Dickenson Bay Street residents take complaints to police chief

A group of 15 residents who live on Dickenson Bay Street have moved their complaints about congestion caused by a mechanic plying his trade on the street a step further by writing to Commissioner of Police Vere Brown.

The residents wrote to the police chief some time in November, outlining their concerns and asking that something be done about the unsightly look of their neighbourhood caused by vehicles left on the side of the road and the hazard to motorists and pedestrians.

The matter was passed on to Assistant Superintendent of Police Joseph Hughes, the officer in charge of the Traffic Department.

Contacted, yesterday, Hughes said Craig White had been asked to remove the vehicles and to cease operating on the roadside. He said the police were concerned because the road is being obstructed as many vehicles are parked for extended periods.

The officer indicated that it was his understanding that the mechanic had been allocated a parcel of land to conduct his business, but he was uncertain why he had not relocated.

“We have to give notice for a person to move,” the traffic cop said. “The law is one thing and the social setting is another.”

The traffic head said it is the police’s intention to have the vehicles removed “soonest,” “but a number of factors come into play.”

The officer could not be pinned to a date to have the situation remedied and would only say it depends on the “assets” available. Pressed to reveal just what he meant, Hughes said the police tow truck.

Not for the first time, the people who live just below the Ministry of Social Transformation are complaining that the vehicles parked on the side of the road present both a nuisance and a hazard.

Long-time resident of 42 years, Selwyn Palmer, told The Daily OBSERVER, “He is endangering people’s lives. Do you know how many times people nearly got hit because they can’t use the sidewalk? Cars hit one another regularly because the road is blocked.”

Another homeowner in the area said the mechanic dumps old oil in the gutters and the smell permeates the houses. She noted, too, that sometimes pedestrians slip while trying to navigate the oil slick.

The officer has added a twist to the homeowner’s complaints, however; he told this newspaper that many of them are law-breakers as well, for they park their vehicles on Dickenson Bay Street, which is in fact a no parking zone.

“There are people living in the area who park on the road. They are committing an offence because this is a prohibited area for parking from 7 am to 7 pm,” Hughes said.

The officer indicated that in the matter of parking the police have had to exercise some leniency.

“We, too, are challenged. We have more vehicles than the station yard on Newgate Street can hold, so officers park their unmarked vehicles on the street, which is a no parking area.”

According to Hughes, a number of streets in St John’s were made one-way or no parking zones in anticipation of the Sunrise Hub Car Park, which is yet unfinished.

It therefore means, ”You can either exercise the law to the letter T or the spirit of the law.”

Antigua and Barbuda: Antigua & Barbuda’s role as disaster response hub under review

Antigua & Barbuda’s role as a disaster response hub for five countries is being reviewed by the Caribbean Disaster Emergency Management Agency (CEDEMA).

Disaster Risk Management Consultant Paul Saunders was in the island yesterday to begin the process that will assess how the National Office of Disaster Services (NODS) has handled its responsibilities as a sub-regional focal point of CEDEMA.

“They have engaged us to undertake a review of the sub-regional focal points’ roles and functions but more specifically to develop an audit instrument that CEDEMA can use on an annual basis to assess the capacity of each sub-regional focal point to see how well they are able to undertake their role and function,” Saunders explained.

Antigua & Barbuda, through NODS, has oversight responsibilities for Anguilla, the Virgin Islands, Montserrat, and St Kitts and Nevis. It means the country is responsible for co-ordinating all efforts designed to limit loss of life and property in those territories.

NODS Director Philmore Mullin said he is eagerly awaiting the results of the assessment.

“We have been activated several times and we would want to know the expectation of CEDEMA … and if we are falling short in any shape or form we would want to know what our shortfalls are so we can put things in place to remedy those,” Mullin said.

Saunders said his visit yesterday was for preliminary work and he is expected to return to the island in March to conduct “a direct assessment of Antigua’s capacity as a sub-regional focal point.”

“We will be looking at what are the gaps which have been identified in particular when it comes to training and equipment needs and CEDEMA will look at how they can fill those gaps,” Saunders said.

Among the key considerations CEDEMA is looking at during the audit are whether Antigua & Barbuda has been keeping proper record of the emergency equipment and personnel in the area for which it’s responsible and whether that information is adequately distributed in all the countries.

CEDEMA also wants to see whether vital equipment has been obtained and being kept in proper working order and also, if adequate planning is in place to get that equipment to people with emergencies.

Assessments are also being carried out in the other three CEDEMA hubs — Barbados, Jamaica, and Trinidad and Tobago.

Antigua and Barbuda: Wadadli Pen’s 2011 challenge: stories for youth by youth

The Wadadli Youth Pen Prize is back with a challenge for young Antiguan and Barbudan writers – can you write an engaging children’s story in 600 words or less?

The competition, dubbed the Best Of Books Wadadli Pen Challenge 2011, is open to writers 35 years and younger, legally resident or native to Antigua & Barbuda. Writing can be fiction, poetry or non-fiction, and can be in any genre, fantasy to comedy, but it must be written to appeal to younger readers.

Organisers say submissions must be the kind of story a parent might read to a child or a young reader would pick up and read on his or her own. As has been the case since the Wadadli Youth Pen Prize was launched in 2004, the writing must reflect a Caribbean sensibility. Stories must have a Caribbean setting and/or in some way reflect the Caribbean experience. This can include the rough and tumble reality, the superstition and mythology, the history or the possibility.

“The world of children’s fiction should allow you to let your imagination fly as Thumbelina did on a lily pad, as Peter Pan and Wendy did simply by wishing it so, as Harry Potter did with a wave of his magic wand, as Dorothy did with three clicks of her ruby slippers,” a release said. “Dream, that’s what this year’s challenge is asking you to do and let’s create literature that can be read and enjoyed by the youngest among us and yet still appreciated by every young-at-heart adult.”

Persons entering in each category – 12 and under, 13 to 17, 18 to 35 – will have more than one opportunity to win. With input from the judges/editors, each short-listed writer will have the opportunity to edit and fine tune the work before final judging. Winning pieces will be published in the local press, posted to HYPERLINK “http://wadadlipen.wordpress.com/”http://wadadlipen.wordpress.com and possibly other sites promoting Caribbean literature, especially children’s literature. Also, Wadadli Pen reserves non-exclusive right to publish/record the winning works in other formats without restriction.

Wadadli Pen is once again partnering with the Best of Books, celebrating its 10th anniversary in 2011, in this venture. Best of Books will sponsor the Challenge plaque displayed in their store with the name of the winning writer; as well as other prizes and certificates. They will also host the prize-giving as a part of their anniversary activities in June.

Prize contributions and commitments, meanwhile, have also come from Seven Seas via local distributor Frank B Armstrong, the International Women’s Club of Antigua & Barbuda, the Antigua & Barbuda International Literary Festival, African American author of Ninth Ward Jewell Parker Rhodes, and Through a Window by Antiguan author Floree Williams. Antigua Nice has agreed to provide a free web page as well to help promote the competition.

Each writer is allowed a maximum of three submissions, which should be sent to HYPERLINK “mailto:wadadlipen@yahoo.com”wadadlipen@yahoo.com no later than March 31, 2011.
